This privacy and cookie policy (“Policy”) describes how AgilityNerd LLC (“Company,” “we,” and “our”) collects, uses and shares personal data when using this website (the “Site”) and the associated mobile application, (the “Application”), together (the “Services”). Please read the following information carefully to understand our views and practices regarding your personal data and how we will treat it. Changes To This Policy #

We will post any modifications or changes to the Policy on our Services. We reserve the right to modify the Policy at any time, so we encourage you to review it frequently. The “Last Updated” legend below indicates when this Policy was last changed. If we make any material change(s) to the Policy, we will post a notice on our Services prior to such changes(s) taking effect.

What Information We Collect #

  • We collect your name, email address and password at signup. We use your email address to send you communication essential to providing the Services, including registration confirmation and password reset email. We also use your email address to provide you with information about the Services or notify you about product updates and community activity. You may opt out of these non-essential emails by clicking the unsubscribe link in any of the emails.
  • The Services use the third party, Auth0 authentication service to perform logins and user verification. The Services never have access to your password. We recommend that you use a unique password for every online service you use.
  • If you sign up for the Services at the Masters or Professional level, we do not have access to your payment information.

Accessing or Correcting Your Personal Information #

If you have registered an account using the Services, you can access, correct, delete, or change the information you provided to us that is associated with your account through the profile page of the app. If you need to update your email address send an email to support@agilitycoursemaster.com

If you are a resident of the EU/EEA, you are entitled to request an export of your personal information in a machine-readable format. To request an export, contact us at support@agilitycoursemaster.com

Security #

The Company has implemented processes intended to protect user information and maintain security of data. It is each user’s responsibility to protect the security of his or her login information. We have attempted to protect the Service’s servers by locating in them areas with security procedures, using firewalls and implementing other generally available security technologies.

These safeguards help prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of data, but NO GUARANTEE CAN BE MADE THAT YOUR INFORMATION AND DATA WILL BE SECURE FROM INTRUSIONS AND UNAUTHORIZED RELEASE TO THIRD PARTIES.

Cookies #

The Services use cookies and similar web browser technologies, like local storage, to help make it easier to use our service. For example, we use them to help keep you logged in and remember your preferences.

We also use cookies to gather information about user behavior on the Services. For example, we may measure how often you use one of the Service’s features. We use this information to help plan development of new features, and to tailor direct marketing to how you use the Services. Do Not Track Signals #

How We Use Your Personal Data #

We use data we collect from your account to:

  • operate, maintain, and improve the Services;
  • manage you account;
  • send you communication essential to providing service, including registration confirmation and password reset email;
  • promote the Services to you by email; and
  • notify you about our product, new features, subscription offers, and community activity or events.

You can opt out of all email notifications by clicking the unsubscribe link in any marketing email you receive from us.

Third Parties #

We process member and visitor data through third parties when it is necessary for the operation of theServices. For example, we use the App Store and Google Pay to process payment for subscriptions to the Services.

We may also share member or visitor data with a third party:

  • if required to do so by law or if in good faith, the Company believes that such access, preservation or disclosure is reasonably necessary to: 1) comply with any legal process, including but not limited to an enforceable court order or lawful third party subpoena; 2) enforce this Privacy Policy; 3) respond to claims that any Content violates the rights of third parties; or 4) protect the rights, property or personal safety of the Company, its users and/or the public; or
  • if the Company is acquired by or merged with another company. In this event, Company will notify you before information about you is transferred and becomes subject to a different privacy policy.

We do not sell or share your personal information to third parties for their marketing or advertising purposes.

Anonymous Data #

We use Google Analytics to gather anonymous data about our visitors. We do not collect personally identifying information through Google Analytics. You can opt out of Google Analytics tracking with Google's opt out tool.

User Generated Content #

You may share personal data with us when you submit user generated content to the Services, please note that any information you post or disclose will become public information, and will be available to other users of the Services and to the general public. We urge you to be very careful when deciding to disclose your personal data, or any other information, on our Services. Such personal data and other information will not be private or confidential once it is published on our Services.

If you provide feedback to us, we may use and disclose such feedback on the Services, if you have provided your consent to do so, we may post your first and last name along with your feedback. We will collect any information contained in such feedback and will treat the personal data in it in accordance with this Policy.

Account Deletion #

You can delete your Services account by sending email to support@agilitycoursemaster.com. When you delete your account, all of the data we hold about your account on the Services is deleted. Deletion is permanent and irreversible. If you want to save anything from your account, you can ask for an export of it before deleting your account.

Compliance with Children’s Online Privacy Protection Act #

The Services are available only to individuals who have the capacity to form legally binding contracts under the law applicable to our Terms of Service. The Company does not target its offerings toward, and does not knowingly collect any personal information from users under 13 years of age, or 16 years of age if residing in the EU/EEA. If we become aware that we have unknowingly collected personal information from a child under the age of 13 (or 16 in EU/EEA), we will delete that information.
